1. Acceptance of Terms

Welcome to DStv Stream. These Terms of Service ("Terms") govern your access to and use of the DStv Stream streaming service, including our website, mobile applications, smart TV applications, and any other platform where our services are available (collectively, the "Service").

By creating an account, accessing, or using the DStv Stream Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

These Terms constitute a legally binding agreement between you and DStv Stream (Pty) Ltd, a company registered in South Africa (registration number 2020/123456/07), with our registered office at 123 Stream Street, Cape Town, 8001, South Africa.

Important Notice

These Terms include provisions that limit our liability and require you to resolve disputes through arbitration on an individual basis rather than through jury trials or class actions. Please read Section 16 (Dispute Resolution) carefully.

2. Service Description

DStv Stream provides a subscription-based streaming service that allows you to access a curated library of movies, TV shows, documentaries, live sports, and other video content (collectively, "Content").

  • On-demand streaming of Content
  • Live streaming of sports and events
  • Offline downloads on supported devices
  • Multiple user profiles per account
  • Personalized recommendations
  • Multi-device streaming based on your subscription tier

Service Availability

The DStv Stream Service is currently available in South Africa, Nigeria, Kenya, Ghana, and other select African countries. Content availability may vary by region due to licensing restrictions.

Changes to the Service

We continuously update and improve our Service. We may add, modify, or remove features, change pricing (with notice), or alter Content availability at our discretion. We will make reasonable efforts to notify you of material changes that adversely affect your use of the Service.

3. Eligibility

To use the DStv Stream Service, you must:

  • Be at least 18 years old, or the age of majority in your jurisdiction
  • Be a resident of a country where the Service is available
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information

Age Restrictions

If you are under 18 but at least 13 years old, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

Children under 13 are not permitted to use the Service or create accounts. We do not knowingly collect personal information from children under 13.

4. Account Registration and Security

Creating an Account

To access the DStv Stream Service, you must create an account by providing:

  • A valid email address
  • A secure password
  • Payment information for subscription billing
  • Other information as required during registration

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your account information remains accurate and up to date

Account Sharing

Your DStv Stream account is for your personal use and may be shared only with members of your household. You may not:

  • Share your account credentials with people outside your household
  • Sell, rent, or transfer your account to another person
  • Use your account for commercial purposes

Multiple Profiles

Depending on your subscription tier, you may create multiple user profiles within a single account. Each profile can have personalized settings and recommendations.

5. Subscription Plans and Billing

Subscription Tiers

DStv Stream offers various subscription plans with different features, including:

  • Basic Plan: Standard definition, 1 screen at a time
  • Standard Plan: High definition, 2 screens simultaneously
  • Premium Plan: 4K Ultra HD, 4 screens simultaneously
  • Family Plan: 4K Ultra HD, 6 screens, enhanced parental controls

Pricing and Payment

Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. All prices are displayed in your local currency and are inclusive of applicable taxes unless otherwise stated.

Payment Methods

We accept various payment methods, including:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • Mobile money (MTN Mobile Money, Vodacom, Airtel Money, M-Pesa)
  • Bank transfers and direct debit
  • Gift cards and promotional codes
  • Third-party payment processors (PayPal, Paystack, Flutterwave)

Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. By subscribing, you authorize us to charge your payment method for recurring subscription fees.

Price Changes

We may change our subscription prices from time to time. We will notify you at least 30 days in advance of any price increase. If you do not agree to the price change, you may cancel your subscription before it takes effect.

Failed Payments

If a payment fails, we will attempt to charge your payment method again. Your Service may be suspended until payment is successfully processed. After multiple failed payment attempts, your subscription may be cancelled.

6. Free Trials and Promotional Offers

We may offer free trials or promotional subscriptions to new or returning subscribers. These offers are subject to additional terms and limitations:

Free Trial Terms

  • Free trials are limited to one per household
  • You must provide payment information to start a free trial
  • Your subscription will automatically convert to a paid subscription at the end of the trial period unless you cancel
  • We may verify your eligibility and prevent abuse of free trial offers

Promotional Offers

Promotional offers (discounts, bundle deals, partner offers) are subject to specific terms provided at the time of the offer. Promotional prices apply only for the specified period and will revert to standard pricing thereafter.

7. Cancellation and Refunds

Cancellation by You

You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation will take effect at the end of your current billing period.

Upon cancellation:

  • You will retain access to the Service until the end of your paid billing period
  • No further charges will be made to your payment method
  • Your viewing history and account settings will be preserved for 12 months
  • Downloaded content will become unavailable for offline viewing

Refund Policy

Subscription fees are generally non-refundable. However, we may provide refunds at our discretion in the following circumstances:

  • Technical issues preventing you from accessing the Service
  • Billing errors or unauthorized charges
  • Service availability issues in your region
  • Within 14 days of your first subscription payment (first-time subscribers only)

Termination by DStv Stream

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity. In case of termination for cause, no refund will be provided.

8. Use License and Restrictions

Limited License

Subject to your compliance with these Terms, DStv Stream grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and stream Content for personal, non-commercial use
  • Download select Content for temporary offline viewing on supported devices

Prohibited Uses

You may not:

  • Copy, distribute, publicly perform, or publicly display any Content except through our Service
  • Circumvent, remove, or disable any content protection or security features
  • Use any automated means (bots, scrapers, data miners) to access the Service
  • Record, capture, or download Content using screen capture or recording software
  • Modify, reverse engineer, or create derivative works from the Service
  • Use the Service for commercial exhibition or public performance
  • Sell, rent, lease, or sublicense your account or access to the Service
  • Bypass geographic restrictions or access Content not available in your region
  • Share account credentials with unauthorized users
  • Interfere with or disrupt the Service or servers

Downloads

Where available, you may download Content for offline viewing. Downloaded Content:

  • Must be viewed within the DStv Stream app on authorized devices
  • Is subject to expiration and viewing limits
  • May not be transferred to other devices or storage media
  • Will become unavailable if your subscription is cancelled or expires

9. Content Ownership and Rights

DStv Stream Content

All Content available on the DStv Stream Service, including but not limited to videos, images, text, graphics, logos, and software, is owned by DStv Stream or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Trademarks

DStv Stream, the DStv Stream logo, and other marks used on our Service are trademarks or registered trademarks of DStv Stream (Pty) Ltd. You may not use these marks without our prior written permission.

User Content

If you submit feedback, reviews, ratings, or other content to DStv Stream ("User Content"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and display such User Content for any purpose.

10. Parental Controls and Age Ratings

DStv Stream provides parental control features to help you manage what Content can be accessed on your account.

Content Ratings

Content on DStv Stream is rated based on age-appropriateness using local rating systems (e.g., NFVCB ratings in Nigeria, FPB ratings in South Africa). Ratings are displayed for each piece of Content.

Parental Controls

You can set up PIN-protected parental controls to:

  • Restrict access to Content based on age ratings
  • Block specific titles
  • Create Kids profiles with age-appropriate Content only
  • Require a PIN to access mature Content

Parental Responsibility

Parents and guardians are solely responsible for determining what Content is appropriate for their children to view. DStv Stream provides tools to assist, but cannot guarantee that all Content will meet your standards.

11. Privacy and Data Collection

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using DStv Stream, you consent to our collection and use of your personal information as described in the Privacy Policy, including:

  • Account and billing information
  • Viewing history and preferences
  • Device and technical information
  • Usage data and analytics

12. Geographic Restrictions and Content Availability

The DStv Stream Service and Content availability vary by geographic location due to licensing agreements and legal restrictions.

Geographic Limitations

  • You may only access the Service from countries where it is available
  • Content available in your region may differ from other regions
  • We use technology to determine your geographic location
  • Attempting to bypass geographic restrictions violates these Terms

VPN and Proxy Use

We reserve the right to restrict access to the Service if we detect the use of VPNs, proxies, or other technologies designed to bypass geographic restrictions.

13. Third-Party Services and Links

The DStv Stream Service may contain links to third-party websites, services, or advertisements. We do not control and are not responsible for:

  • The content, accuracy, or practices of third-party websites
  • Products or services offered by third parties
  • Privacy practices of third-party services

Your interactions with third parties are solely between you and the third party. We encourage you to review the terms and privacy policies of any third-party services you use.

14. Disclaimers and Limitations of Liability

Service Provided "As Is"

THE STREAMHUB SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantee of Availability

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Content will always be available or error-free
  • Defects will be corrected
  • The Service is free of viruses or harmful components

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMHUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO STREAMHUB IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability will be limited to the extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless DStv Stream, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your User Content or any content you submit

16. Dispute Resolution and Arbitration

Informal Resolution

If you have a dispute with DStv Stream, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will work in good faith to resolve your concerns.

Binding Arbitration

If we cannot resolve a dispute informally within 60 days, either party may initiate arbitration. You agree that disputes will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Arbitration Rules

  • Arbitration will be conducted by the Arbitration Foundation of Southern Africa (AFSA)
  • Arbitration will take place in Cape Town, South Africa
  • The arbitrator's decision will be final and binding
  • Each party will bear its own costs unless otherwise awarded by the arbitrator

Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS-WIDE ARBITRATION.

Governing Law

These Terms are governed by the laws of South Africa, without regard to conflict of law principles.

17. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending an email to the address associated with your account
  • Displaying a notice on the Service

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must cancel your subscription.

18. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any other terms incorporated by reference, constitute the entire agreement between you and DStv Stream regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver

Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision or any other provision.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Force Majeure

We will not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or telecommunications failures.

20. Acknowledgment

BY CREATING AN ACCOUNT AND USING THE STREAMHUB SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.

You also acknowledge that these Terms constitute a binding legal agreement between you and DStv Stream (Pty) Ltd.
